Quarantine Conditions Returning To Work In Shanghai & Wages

According to data from DXY (Chinese name 丁香园), today 5 February at 11 a.m., there are 24,363 ill citizens, 23,260 suspected patients, 3,219 critical stage, 491 deaths, and 897 patients cured.
The Corona Virus outbreak shows that prevention and control measures for the 2019-nCoV has entered a critical stage.
This week (from 3 to 7 February), except for some special industries, most companies in Shanghai have delayed returning to workplaces as required by the government. In some cases, however, companies have restarted activities and requested employees to work at home. All companies are already planning the returning of employees to workplaces from next week, 10 February 2020.
A&Z Attorneys has been asked several times these days the following questions:
-
Whether the company still needs to take quarantine measures when employees return to work.
-
What happened with those employees returning from Key Epidemic Areas?
-
What are the criteria for quarantine conditions?
-
What is the salary that employees should be paid during the quarantine period?
-
What is the salary for those who are suspected patients?
-
How to treat employees claiming they are sick but it is not Corona Virus?
After answering repeatedly all these questions, A&Z Labour and Compliance (CSR) Department has decided to create a picture to show in one single image basic steps and measures companies can take in the coming days. The image describes the quarantine conditions applicable to Shanghai enterprises’ employees returning to work after February 10 (or February 4 for enterprises in special industries). It also suggests wages conditions and types of leave for employees depending on quarantine conditions.
Special note: Despite the analysis of the present laws and regulations, there is no mandatory quarantine requirement for employees returning to the workplace in Shanghai or visiting Shanghai. Nevertheless, certain local authorities are prone to compulsory quarantine conditions or have implied to take those measures. Companies must pay attention and communicate with relevant official departments to handle these special circumstances.
