Environment and EHS compliance: legal updates and business cases

China's Environmental Law and Regulatory Scheme:
How Does It Affect Your Business?
Legal Updates, Business Cases & Networking
19 November
OCEA HUB (Xuhui) 6/F, Xiangyan South Road 218
Introduction
According to the Ministry of Ecology and Environment, 186,000 environmental violations had been punished in 2018 with fines totaling RMB 15 billion, increasing 32% from the year before. It is foreseen that the Chinese Government will maintain a high pressure of environmental protection to companies for a mid-term. In recent years, the Chinese government has made efforts to address environmental quality that have included the enactment of new laws on air pollution, water pollution, and contaminated sites, and provisions strengthening enforcement. While PM2.5 levels have declined significantly, much work remains to enjoy clean air quality, and restore, water pollution and soil contamination.
China’s environmental regulations are constantly changing. For example, the expanded scale of eligible plaintiffs in environmental lawsuits and the possibility of an enormous amount of compensation to victims will expose companies with great environmental risks. Other stricter regulations and measures also require companies to improve their capacity of managing environmental risks and disclosing data. This development and trends already have a significant impact on business operations of both foreign companies and their suppliers in China. It’s imperative to stay on top of the who, what, when, where, why, and how necessary to understand, achieve, and maintain compliance.
