A&Z Past Events

30 July, Shanghai


A&Z European-American Desk Team visited the Shanghai International Arbitration Center (SHIAC). Trainees from Europe, Japan, Hong Kong and Taiwan also participated in the visit. The activity aimed at facilitating the cooperation between A&Z and SHIAC and enhancing the trainees’ knowledge of the legal system and practice of Arbitration Law of the People’s Republic of China.

26 July, Shanghai
Servicing as one of the organizers of the “Taiwan Legal Youth Elites” project in Jingan District, A&Z welcomed and arranged a one-day trip to Jinshan District for 26 Taiwanese interns participating in the project. The trip included visits to the Jinshan District Urban Planning Exhibition Center, Jinshan Zui Fishing Village and Cross-Strait Youth Entrepreneurship Base, aiming to let the participants know more about the history, culture and technological development of Shanghai.

The A&Z Overseas investment team attended the “Alagoas Business Summit 2019” hosted by Alagoas province (Brazil), Camara Chinesa de Comercio do Brasil and Invest Shanghai. In the event, speakers such as Alagoas Governor presented business advantages and investment projects opportunities showing successful cases.

Director of Overseas Investment Projects at A&Z, Ms. Mireia Paulo, together with Principal Partner of BN Lawyers, Bruno Nunes represented IURISGAL international law firm network signing a cooperation agreement with Vice President of Hengqin Development Limited Liability Company, one of three solely state-owned companies under Hengqin New District Administration Commission, Liu Yang. On the basis of "The Belt and Road" strategy and relying on the industrial and political advantages of Hengqin Free Trade Zone, both parties are committed to deepening the cooperation between China and Latin America as well as building the Hengqin FTZ into an economic and trade platform for the regions.

Ms. Sophie An, Principal Partner at A&Z, was invited to attend the Advanced Business Administration Seminar organized by Keio University in Japan, Osaka. In the seminar, Ms. Sophie had the pleasure to meet with senior management of the major Japanese companies to share and discuss their views.

16 July, Shanghai


Andrew Zhang, Senior Partner at A&Z, and Ms. Mireia Paulo, Director of the Overseas Investment Projects, together with European trainees attended an activity entitled Sustainable Investment Along the Belt and Road: Comparative Perspectives organized by Swissnex China. In the activity, issues such as the creation of the opportunities for the knowledge-exchange between China and Switzerland, the promotion of Sino-Swiss project cooperation, and the establishment of the Sino-Swiss network were discussed.

Ms. Sophie An, Director and Principal Partner at A&Z, accompanied Mr. Charles C. Jose, the Philippine Consul-General in Shanghai, to visit Shanghai Municipal History Museum and had a discussion about the further development of China.

In the morning on 10 July, the 4th launching ceremony of Jingan District “Taiwan Legal Youth Elites” Program was held in Shanghai 800 Show. As a mentor and Executive Director and Senior Partner of A&Z, Peter Zeng was invited to attend the ceremony. This year, 26 talented Taiwanese interns from 5 universities such as National Taiwan University, National Chengchi University and Soochow University participated in the program.

8 July, Shanghai

Ms. Haiying Xian, Head of A&Z's Dalian office, delivered a speech at the seminar for the Logistics and Communication Department of the Shanghai Japanese Commerce and Industry Club organized by Nippon Express (China) Company Limited. The speech addressed foreign investment law and commercial bribery. As an expert on international logistic, Andrew Zhang, Senior Partner at A&Z, also participated in the seminar and follow-up gathering, sharing his views on the latest laws and practices with the Japanese businessmen.

NDRC Gathers Public Opinions on Regulation for Optimizing Business Environment

The National Development and Reform Commission released on July 14, 2019, the Regulation for Optimizing Business Environment (Exposure Draft) to gather public opinions until August 12, 2019.
According to the exposure draft, China implements a unified national system on market access negative list, and industries, fields, and businesses outside the negative list are accessible to all types of market entities. China will push for better corporate governance, strengthen protection of shareholders, especially minority investors, and create favorable conditions for shareholders to defend their legitimate interest. The people's governments at all levels and relevant departments shall actively communicate and coordinate with the courts to strengthen protection of the interests of minority shareholders.

SAMR Plans to Revise Measures for the Administration of the List of Entities with Serious Illegal and Unfaithful Activities

The State Administration for Market Regulation released on July 10, 2019, the Measures for the Administration of the List of Entities with Serious Illegal and Unfaithful Activities (Exposure Draft) to gather public opinions until August 10, 2019.

According to the exposure draft a market entity's credit status would not be repaired under any of the following circumstances:

(1) It caused serious consequences to national security, public safety as well as people's personal and property safety;

(2) After securing approval to repair its credit status, it committed serious illegal and unfaithful activities and was added to the credit blacklist;

(3) It's entering the process of liquidation or bankruptcy (Excluding a court-ordered bankruptcy restructuring).

SAMR Releases Regulation for Market Supervision and Management Offices to Gather Public Opinions

The State Administration for Market Regulation released on July 8, 2019, the Regulation for the Market Supervision and Management Offices to gather public opinions until August 8, 2019.

According to the draft, a market supervision and management office assumes the following duties:

(1) Publicize and implement laws, regulations and policies related to market supervision;

(2) Make registrations and administrative approvals for market entities;

(3) Conduct routine market inspections and special crackdowns, and strengthen quality inspections on food, drug, special equipment and other products;

(4) Handle simple procedure cases for breaching market regulation laws and rules, and handle general procedure cases authorized by county or municipal administration of market regulation;

(5) Accept inquiries and complaints from local consumers;

(6) Participate in joint drills to deal with market emergencies; and

(7) Other duties as stipulated by laws and regulations.

MOFCOM Gathers Professional Opinions on Standards for Evaluating Credit Archives of E-commerce Enterprises

The Ministry of Commerce released on July 4, 2019, the Standards for Evaluating Credit Archives of E-commerce Enterprises, to gather opinions from industry associations and e-commerce firms until July 19, 2019.

The document made provisions about the content of credit archives, source of information, evaluation model, evaluation indicators and their respective weightings, as well as evaluation procedures. The standards apply to the management of credit archives by government departments, e-commerce platforms, third-party credit service providers and industry associations.

SAMR Releases Three Regulations against Monopoly

The State Administration for Market Regulation released three documents on July 1, 2019, and they are set to take effect from September 1, 2019. The three documents are the Interim Provisions on Prohibiting Monopoly Agreement, the Interim Provisions on Prohibiting the Abuse of Dominant Market Positions, and the Interim Provisions on Stopping the Abuse of Administrative Powers to Exclude or Limit Competition.

According to the Interim Provisions on Prohibiting Monopoly Agreement, a monopoly agreement is an agreement, decision or concerted move to exclude or limit competition. In a concerted move, business operators do not sign a specific agreement or make a joint decision, but they take coordinated and consistent actions. The following factors should be taken into consideration when determining whether the business operators are in a concerted move;

(1) Whether the operators are taking consistent market actions;

(2) Whether the operators have contacted or communicated with each other;

(3) Whether the operators can make reasonable explanations for their consistent market actions;

(4) The market structure, competition landscape and market changes.

MIIT Issues Action Plan for Telecommunication and Internet Industries to Improve Capacity of Data Security Protection

The Ministry of Industry and Information Technology released on July 1, 2019, the Special Action Plan for Telecommunication and Internet Industries to Improve Capacity of Data Security Protection.

The action plan outlined five tasks of formulating data security standards, conducting compliance evaluations and special inspections. The action plan required relevant departments to launch regular inspections on the mobile app market to spot illegal gathering and use of users' personal information. Apps with illegal activities in data security and user information protection should be made public and removed from app stores.
