[Shenzhen] New Requirements for Enterprise Data Compliance

Data compliance is an important component of corporate compliance. In daily business operations, irregularities in data handling may cause economic losses to enterprises, or even  criminal penalties in serious cases. Recently, the Shenzhen Procuratorate, in collaboration with multiple departments, issued the “Shenzhen Enterprise Data Compliance Guidelines” (‘The Guidelines’) proposing new requirements and guidelines for enterprise data compliance.

The Guidelines include the construction of a data security compliance management organization system, full data lifecycle compliance, data exit compliance and bylaws, and more, guiding enterprises to carry out data compliance management, improving their awareness of data compliance and data protection levels, and providing comprehensive and detailed normative guidelines for various data scenarios. In particular, for the first time, the Guidelines establish exemptions and fault-tolerant mechanisms for enterprise data transactions, which help promote the circulation and trading of data elements in a compliant and efficient manner, and facilitate the development of data element market.

Data is an important production factor, and compliant use of data can support the long-term development of enterprises. Relevant enterprises can take into account their own actual situation, refer to the content of these Guidelines, and, under the guidance of professionals, establish and improve their data compliance system.
